Annex III — Requirements by product category and seal criteria
Annex to CanGerard's General Terms and Conditions of Contract for Sellers. This Annex also serves as the functional specification of seller onboarding and of the listing fields by category. If the language versions diverge, the Spanish version prevails.

1. Nature and application
1.1. This Annex specifies, by category, the requirements that the Seller must meet and evidence in order to publish Products, the mandatory listing fields, and the logistics and withdrawal particulars. It supplements the Prohibited Products and Content Policy. 1.2. The Platform may at any time request the supporting documentation and deactivate the affected listings until it is provided.
2. General onboarding declarations (all categories)
Upon registering and when publishing each Product, the Seller declares that: (a) it only offers products that are safe and compliant with the applicable legislation (Regulation (EU) 2023/988); (b) it does not offer products or content included on the prohibited list; (c) the traceability details in the listing are truthful; and (d) it holds the authorisations, registrations and certifications required by its activity and categories, undertaking to report their loss or expiry.
3. Common mandatory listing fields
Every physical product listing shall include: identification of the product (name, brand, reference); manufacturer (name or company name and postal or electronic address); the responsible person in the EU where the manufacturer is not established there; warnings and safety information in Spanish; the final price including taxes; shipping costs or method; the dispatch period; and the existence or exclusion of the right of withdrawal according to the category.
4. Requirements by category
4.1. Packaged food. Seller registered with the RGSEAA or the equivalent regional health register (number verified at onboarding). Listing containing the mandatory information under Regulation (EU) 1169/2011 available before purchase (name of the food, ingredients with allergens highlighted, net quantity, storage conditions and, where applicable, conditions of use, food business, country of origin where mandatory, nutrition information), at least in Spanish. Lot number and dates on the physical packaging. 4.2. Fresh and perishable goods. In addition to 4.1: insulated packaging and, where appropriate, coolants; dispatch windows that prevent transit times exceeding the shelf life (avoiding weekend deliveries unless an appropriate delivery method is used); indication in the listing of the minimum shelf life guaranteed upon delivery. Category marked as excluded from withdrawal. 4.3. Food supplements. Product notified to the AESAN or to the competent regional authority (RD 1487/2009), evidenced upon request. Claims of prevention, treatment or cure are prohibited; only authorised nutrition and health claims (Regulation (EC) 1924/2006). Mandatory labelling warnings reflected in the listing. 4.4. Alcoholic beverages (wine, beer, spirits). Only products packaged and labelled in accordance with their applicable regulations (alcoholic strength, allergens, lot number; for wine, ingredients and nutrition information in accordance with the legislation in force, where applicable by electronic means). Category marked "+18": the Site prevents purchase by accounts not verified as being of legal age, and delivery may require an age check. Promotions that encourage excessive consumption or target minors are prohibited. The Seller shall comply with the restrictions of the destination autonomous community applicable to the distance selling of alcohol. 4.5. Cosmetics. Product notified in the CPNP with an identified responsible person in the EU; labelling compliant with Regulation (EC) 1223/2009 (INCI ingredients, precautions, PAO/date of minimum durability). Hygiene seals shall be indicated in the listing for the purposes of withdrawal. 4.6. Fashion and textiles. Fibre composition labelling in accordance with Regulation (EU) 1007/2011, reflected in the listing; for footwear, materials labelling in accordance with its regulations; sizes and care instructions. 4.7. Home, decoration and crafts. General safety (Regulation (EU) 2023/988); where they incorporate substances or mixtures (candles, air fresheners, dyes), hazard labelling in accordance with the CLP Regulation reflected in the warnings; instructions for use in Spanish where necessary for safe use. 4.8. Toys. CE marking, age warnings (e.g. "not suitable for children under 36 months" together with the reason) and safety warnings in Spanish, identification of the manufacturer and the importer. Toys subject to a safety alert are prohibited. 4.9. Electronics and electrical appliances. CE marking and declaration of conformity available; RoHS. The Seller warrants that the appliances come from producers registered in the Registro Integrado Industrial (WEEE section) and assumes its obligations as a distributor under RD 110/2015, including free 1:1 take-back of an equivalent appliance in distance sales, the manner of exercising which shall be indicated in the listing. Compliant batteries and accumulators, with their warnings. 4.10. Books (print). Fixed-price regime (Ley 10/2007): the price is set by the publisher or importer and the general maximum discount is 5%, with the only exceptions permitted by law (among others, second-hand, remaindered or out-of-print books). The Seller shall enter the fixed price and the Platform may block non-compliant discounts. 4.11. Second-hand and refurbished. Condition stated in the title and in the listing, with a truthful description of the state, defects and items not included; for electronics, factory reset and erasure of previous data. Agreed legal guarantee of conformity never shorter than 1 year, stated in the listing (failing which, 3 years apply). 4.12. Digital content (ebooks). The Seller warrants that it is the holder or licensee of the digital distribution rights for Spain in the formats offered; the listing shall state the format, language, compatibility and, where applicable, the existence of DRM or watermarking. Immediate download is enabled only after the Buyer's express consent with informed waiver of the right of withdrawal (Site mechanism). Digital books are likewise subject to the fixed-price regime under the terms of Ley 10/2007. 4.13. Experiences and workshops. Listing containing: identity of the organiser, place, date or date options, duration, participant requirements (minimum age, physical condition, equipment), language, and the organiser's change and cancellation conditions. The organiser declares that it holds the licences and insurance required for its activity (civil liability and, where applicable, accident insurance) and that it complies with the applicable sector regulations. Services with a specific date or period are excluded from withdrawal; in the event of cancellation by the organiser, a full refund or the option to reschedule, at the Buyer's choice. 4.14. Kitchen and professional cutlery. Only items for domestic, table or professional/hospitality use. "+18" category with the same verification rules as alcohol. Items covered by section 2.5 of the Prohibited Policy are prohibited.
5. CanGerard seals: criteria and accreditation
5.1. «Fet a Catalunya». Product manufactured or produced entirely, or in its substantial phase, in Catalonia. Accreditation: a responsible declaration plus, upon request, proof of the production site in Catalonia (tax census registration or activity licence of the site, deeds, description of the production process, origin labelling, third-party certificates). 5.2. «Empresa Catalana». Product marketed by a company with its registered office or effective decision-making centre in Catalonia whose production takes place elsewhere. Accreditation: a registry extract or deed and a declaration of the place of production. 5.3. «Distribuïdor Català». Product of a non-Catalan company distributed by a Seller with its registered office or principal establishment in Catalonia. Accreditation: the Seller's registry details and the distribution contract or authorisation. 5.4. Common rules. A product may bear only one seal, the highest-ranking one it can evidence (FaC > EC > DC). Graphic use of the seals belongs exclusively to the Platform within the Site; the Seller may not use them outside the Site without authorisation. Any supervening loss of the requirements must be reported immediately; misuse constitutes a serious breach (clause 20 of the Terms) and entails removal of the seal and of the affected listings.
6. Regulated claims
• "Ecological"/"bio"/"organic": valid organic-operator certificate (Regulation (EU) 2018/848) with the code of the control body, uploaded to the Panel; the attribute and the filter are only activated while a certificate is in force. • PDO/PGI: accreditation from the relevant regulatory council or management body. • "Artisan"/"artisanal": official regional accreditation where it exists (in Catalonia, the artisan card or diploma or registration in the corresponding register) or, failing that, objective justification of the artisanal nature of the process.
7. Updating
The Platform shall update this Annex whenever sector regulations change or new categories are opened, in accordance with the amendment procedure of the Terms (minimum prior notice of 15 days, except for changes required by legal obligation).
