Terms of Use
These terms govern your use of CanGerard as a buyer, seller or visitor. By using the platform you agree to them.
Effective date: 24 May 2026
Preliminary terms — pending a final review by our legal counsel before they replace any prior version you may have agreed to.
1. Acceptance of terms
By accessing or using CanGerard you confirm that you have read, understood and agree to be bound by these Terms of Use and our Privacy Notice. If you do not agree, please don't use the service.
2. Eligibility
You must be at least 16 years old to register a buyer account, and 18 or older to register as a seller. By creating an account you confirm that the information you provide is accurate and that you have the legal capacity to enter into binding contracts.
3. Your account
You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Let us know immediately if you suspect unauthorised access. We may suspend accounts that breach these terms or are used to harm other users.
4. Selling on CanGerard
Sellers must be based in Catalonia, accurately represent the products they list, ship orders within the timeframe they advertise and handle returns in line with applicable consumer law. CanGerard reviews every seller before approval and may suspend accounts that fail to meet these standards.
5. Orders, payments and shipping
When you place an order you enter into a sale contract directly with the seller. CanGerard processes the payment on the seller's behalf via Stripe Connect and handles the shipping label generation via Sendcloud, but the seller is responsible for fulfilling the order. Prices include VAT where applicable.
6. Intellectual property
All CanGerard branding, software and editorial content is owned by CanGerard or its licensors. Product photography and descriptions remain the property of the sellers who upload them; sellers grant CanGerard the right to display that content for marketing and operational purposes.
7. Limitation of liability
To the extent permitted by applicable law, CanGerard's liability is limited to the amount of any affected order. We are not liable for indirect or consequential damages. Nothing in these terms limits any rights you have under mandatory consumer-protection law.
8. Changes to these terms
We may update these terms from time to time. Material changes will be announced via email or a banner on the site, and will take effect on the date stated. Continued use after that date constitutes acceptance.
9. Governing law and jurisdiction
These terms are governed by Spanish and Catalan law. Disputes arising from your use of CanGerard are subject to the exclusive jurisdiction of the courts of Barcelona, without prejudice to your rights as a consumer.
